According to Panorama Commission Survey , 87 % of the Parents don't know what their children doing online ...!! Though the internet is a fascinating place , where children learn, discover and have fun . It can also be a place that is extremely dangerous in a few clicks away. 
The CACRC ( Crimes Against Children Research) found that 66 % of children aged between 10-19 are exposed to online pornography . The Responsibility lies on the Parents to ensure that their Children are safe online.

APPLICATION UNDER SECTION 151 OF THE CODE OF CIVIL PROCEDURE FOR THE GRANT OF TEMPORARY INJUNCTION

Respectfully Sheweth:
That the brief facts leading to the filling of the instant application are stated hereto below:
1.     That the petitioner has filed a writ petition bearing No. 13737/2011 which was fixed for hearing before His Lordship Mr. Justice Shehzad Malik , of the Honourable Lahore High Court , who very graciously issued Notices and called for Para wise comments from the Respondents within four weeks time. However no date has been fixed by the Court.

2.     That the contents of the accompanying writ petition may kindly be treated as an integral part of this application, that it is further submitted with respect that despite the fact that Notices have been issued to the Respondents yet they are adamant to take effective measure to curb communication, conveyance, broadcasting, , disclosure, dispel, disseminate, divulge, issuance,  proclamation, publication, publicity, publish, spread, or airing of porn material in Pakistan.

3.     That it is submitted with respect that the fact that the Respondents are willfully ignoring to understand that it is technically a criminal action being caught on film. The criminal act of being prostitution. Meaning thereby that by not placing an immediate ban oncommunication of obscene, vulgar, profane, lewdly lascivious, or indecent language picture or image or website the Respondents are practically aiding, patronizing and facilitating this criminal activity in the country at a National scale. That according to the facts of the petition, the balance of convenience lies in favour of the petitioner and against the Respondents No. 1-11.

4.     That it is submitted here with respect that after all, even though the people who are filmed in the act of prostitution are considered to be “actors” nothing could be further from the truth. Actors in a real movie or play do not actually engage in the activity that they are portraying while so called adult film “actors” are fully engaged in the activity that is portrayed. That is not acting. In as much as thepetitioner has got a good prima facie arguable case in his favour.

5.     That it is submitted here with respect that the Respondents are not inclined to understand the gravity of the instant issue, their failure to curb easy access of porn material in Pakistan and lack of control over children’s use of Internet, through mushroom growth of video centers, is plunging children into a sexphobic environment in which they can easily be exploited. That it is further submitted here with respect that this painful situation s alarming for us as no doubt, like the US and the West, our children are not exposed to the crime syndicates who can use them as porn star, but they are prone topornography and they are becoming users of this commodity. This trend, if not checked, can one day make them do what they see inpornography. Our children are our most valuable asset. They are considered to be the future of the nation. They are also the most vulnerable members of our society. Protecting our children against the fear of crime and from becoming victims of crime must be a national priority. Unfortunately the same advances in computer and telecommunication technology that allow our children to reach out to new sources of knowledge and cultural experiences are also leaving them vulnerable to exploitation and harm by computer-sex offenders. That there is every likelihood that the case filed by the petitioner will be ordered  in favour of the petitioner

6.     That it is submitted here with respect that it is the basic duty of the Respondents to act in accordance with law and the provisions of the Constitution, it is their moral as well as legal obligation to preserve our family oriented social fabric of our society, however for reasons extraneous in nature or for their ineligibility to comprehend the gravity of the issue, the society at large in specific and the nation in general is bearing the cost of their ineligibility and criminal negligence to deal with the instant matter, for which there lies no compensation.
7.     That it is submitted here with respect that in the peculiar circumstances the negligent acts on the part of the Respondents to curb the effects of publication, displaying, visualizing or airing of porn-sites and explicit material falls within the purview of criminal breach of trust, meaning thereby that the acts and omissions made bythem in the instant crisis amounts to trespass on the valuablefundamental rights, hence they are eligible to be redressed by this Honourable Court.


Prayer
That  It is therefore , respectfully prayed that a temporary injunction/ Stay  may very graciously be issued in favor of the petitioner  and against the Respondent No.2,4,5,6,8&9  restraining them from causing any further communication, conveyance, broadcasting, disclosure, dispel, disseminate, divulge, issuance,  proclamation, publication, publicity, publish, spread, or airing of porn material or communication of obscene, vulgar, profane, lewdly lascivious, or indecent language picture or image, advertisement or website within Pakistan through the medium of Internet & Television, till the final disposal of the instant writ petition.
That it is further most humbly prayed that any other relief that this Honourable Court deems fit and proper may also very graciously be extended in favour of the petitioner in the peculiar circumstances of the instant matter.

Pakistan- In Pornographic Perspective

We’re not done yet, my friends. Mapping this onto Pakistan’s internet penetration percentage, we find that :

1. One out of every 20 Pakistanis is officially committed to internet porn(5% of total population)

2. one out of 33 Pakistani’s (3%) has an illicit sexual relationship (possibly more, not less). 1 out of 50 (2%) get divorced due to infidelity/want of illigitimate lust

3. 12% of Pakistans now officially think that adultery should not be a crime in the ‘Islamic republic of Pakistan’.

4. One out of every nine children has viewed porn in Pakistan (11%). Which implies that you have at least one sibling/cousin on each side (paternal +maternal) who is into porn, even if they are under 15.

5. One out of 40 people (2.5%) access google pakistan to search for porn(for entire population). One out of four internet users in Pakistan use it for searching porn.

6. 1 out of 4 women that see you at work (22.5%) have sexual thoughts about you. 1 out of 4 (25%) men who see you at work have sexual thoughts about you too.

BTW, if you want to map these stats to KHI/ISB/LHR, multiply them by 3, as they are urban areas (internet penetration is greater) and literacy is at 30 %. Need I say more?

The bottom line is – 1 out of two people using the internet turns to porn daily. Which implies that as the internet penetration percentage increases, the entire society is gonna turn into a vast majority of porn addicts, who have nothing but sex on their minds, and dont have the time to focus on their families, their work, or their loved ones, let alone greater social issues. All they will be thinking about is what someone would look like without clothes on, or what sexual position would be best for which figure they see.

Porn? Yes but its meant to be private, with a sense of commitment to it. Without that sense of commitment, its just lust. Making it public = making humans animals easier to control and manipulate. The increasing penetration of internet brings with it this disease, which must be handled at the state level.

How to Register Complaint with FIA (Cyber Crime Wing)

As we are getting into internet era, cyber crime rates are hiking in similar manner. Many of us don’t know how to legally challenge those criminal activities.
A common internet or mobile phone user, who is victim of a cyber crime, thinks that there is no one to listen his/her pleas. Many of victims end up not registering any complaint.
If you are victim of any sort of cyber crime, don’t sit idle, this is the time to react to get the culprits behind the bars. Registering a complaint with FIA’s cyber crime wing is very simple, and even does not require you to go anywhere.

Simply write down your application (in English or in Urdu), narrate your complete problem, provide as much evidences, details as you can and send it to FIA National Response Center for Cyber Crimes(NR3C).

RE-REPLY OF THE PARA WISE COMMENTS SUBMITTED BY THE MINISTRY OF I&T GOVERNMENT OF PAKISTAN i.e. RESPONDENT NO.2 IN THE TITLED WRIT PETITION.


Respectfully Sheweth:
That the brief facts leading to the filling of the instant Re-Reply are given as under:

PRELIMINARY OBJECTIONS

  1. That the comments submitted by the Respondent No. 2 are absolutely irrelevant and frivolous to the contents of the writ petition filed by the Petitioner, hence failed to satisfy the contentions raised by the petitioner against easy access available to the pornographic websites in Pakistan on Internet.
  2. That the comments submitted by the Respondent No.2 are in direct contravention of the principles of natural justice fair play and equity on the face of it .
  3. That the Para wise comments filed by the Respondent are absolutely silent on the subject of pornography save as in accordance with the injunctions of Islam and the law of the land in as much as they  are in direct contradiction of the  injunction of the Holy Quran and Ahadith on the subject of shameless activities to be carried out.
  4. That the Para wise comments so submitted by the Respondent No.2 lacks in their spirit the very answers for which they were asked for,

ON FACTS

  1. 1. Paragraph No. 1 is denied hence irrelevant and absurd on the face of it, the fact of the matter is that the Respondent No. failed to analysis the gravity of the situation resulting as easy access available to porn material in Pakistan through Internet. The fact of the matter is that the petitioner has filed the titled writ petition through which he seeks the redresser of his grievances relating to the easy access available to the pornographic material on the internet in Pakistan. the Respondent No.2 submitted their comments which are irrelevant on the face of it and does not comply with the requirements of the writ petition filed by the petitioner.
    1. That the Paragraph No. (a) of the Para wise comments is absolutely absurd and irrelevant on the face of it , hence vociferously denied. The fact of the matter is that for reasons certainly extraneous in nature the Respondent No.2 very craftily connected the instant matter with that of blasphemous websites including the social networking program like YouTube.com and Facebook.com, whereas the fact of the matter is that the alleged Porn websites has nothing to do with these mentioned programs. It is further peculiar to be noted here that the Respondent No.2 merely kept the Para wise comments filled with paper-work stuff, and have done nothing in actual. That it is further peculiar to be noted here that the Respondent No.2 is not inclined to share the burden of his responsibility which is cast upon him under the provisions of the Constitution and the law of the land. It is further significant to be observed that the Ministry of I&T or the Government of Pakistan only realizes that the appearance and distribution of content affront to the religious and moral values of the Pakistani Citizens, particularly blasphemous and sacrilegious content, at mass level over internet is creating immense discomfort and dismay among people of Pakistan. Surprisingly the Government of Pakistan or the Respondent No.2 are not considering that the easy access  available to pornographic content on internet is also contributing to the acute dismay of the people of Pakistan. As the Respondent No.2 itself has admitted in the Para wise comments so submitted in this Honourable Court, that the Pornographic content falls within the specific criteria as no formal mechanism so far has been established to monitor the said easy access. Neither a single pornographic website so far has been blocked by the Government of Pakistan. It is further peculiar to be noted here that the Respondent No.2 only consider,  websites that propagate propaganda and unscrupulous agendas of inter faith hate, communal disharmony , propagation of discord, blasphemy and anti state content to be objectionable . The fact is further fortified from the perusal of the contents of the Paragraph No. 1. There is not even a single authority in the Islamic Republic of Pakistan who could monitor the free flow of adult material nor is there any one who is concerned in protecting the future of the youth of Pakistan from the catastrophic effects of such an easy access to pornographic websites.
    2. That the contents of Paragraph No. (b) Of the Para wise comments are again frivolous and irrelevant hence strongly denied and condemned. The fact of the matter is that the contention raised in the writ petition is not responded in this paragraph. The contents of this  paragraph are absolutely irrelevant as the contentions raised in the writ petition does not attract the activities carried by the Government of Pakistan, The Inter Ministerial Committee or the Respondent No.2 against Face book or the You tube.  It is further submitted here with respect that the Respondent No.2 is under legal obligation to give priority to the injunctions of Islam and after that to the provisions of the Constitution of Islamic Republic of Pakistan in case if there arises a conflict between the basic Policy observed by the Government of Pakistan in respect of the easy flow to information. The injunctions of Islam are very clear on the point of shameless activity, same is the case with the Constitution of Islamic Republic of Pakistan in addition to the penal laws, hence, by stretch of no imagination any shameless activity strictly prohibited by the Injunctions of Islam or by the provisions of the Constitution or which is punishable under the penal laws of Pakistan can not be carried out under the garb of a Basic Policy of Free Flow of Information. The answer given in this Paragraph is of a general nature in as much as rhetoric has been implied to praise the so called efforts initiated by the Respondent in the discharge of their professional / legal obligations.
    3. That the contents of the paragraph No.3 are irrelevant, absurd and obnoxious on the face of it hence denied and condemned. The fact of the matter is that the word Pornography has for the first time been instituted in the comments and false vows have been raised so as to gain the sympathies of this Honourable Court on the subject. If, for the sake of argument, it is conceded that certain measures have been taken up by the Government of Pakistan in this regard and its report has also been submitted in the Lahore High Court in some other writ petition, even since no plausible action so far has been initiated by the Respondents to bring a halt to the easy access of the pornographic material available on internet in Pakistan. the admission on the part of the Respondent No.2 that certain guidelines so far has been issued by the Honourable High Court to address the issues related to web content in a large policy context, and their inability to act upon them entitles them to be prosecuted for the contempt of this Honourable Court for not acting upon the guidelines so far been issued by this Honourable Court. . That the stance of the petitioner is further fortified from the fact that no such measures so far has been initiated by the Respondents or by the Government of Pakistan to monitor and control the access of pornographic websites on the internet. The stance of the petitioner can easily be verified by this Honourable Court by directing its staff to open the site Google and punch the words of “sex”, this Honourable Court can witness, what actual measures so far has been adopted by the Respondent to act upon the advice of this Honourable Court so far!!
    4. That the contents of Paragraph No. 3 are false and frivolous hence denied and condemned volubly. The real fact of the matter is that the Government of Pakistan has not initiated even a single measure to prohibit the easy access available on the internet to porn material so far. Government of Pakistan is not inclined to acknowledge the fact that the injunctions of Islam in as much as the provisions of the Constitution are very much clear on the subject. Hence the Respondent can not take shelter from discharging its duties under the blanket of a fabricated Policy of free flow of information. The relevant injunctions of Holy Quran, Ahadith, and the provisions of the Constitution of Islamic Republic of Pakistan and the provisions of the penal law dealing with the subject are mentioned here to below:-
 As per the injunctions of Islam it is pertinent to be noted here that the Verse No. 151 of the Surah al Anaam, Pornography is strictly prohibited. The said verse is reproduced below for the perusal of this Honourable Court   “ Say (O Muhammad صلى الله عليه وسلم): "Come, I will recite what your Lord has prohibited you from: Join not anything in worship with Him; be good and dutiful to your parents; kill not your children because of poverty - We provide sustenance for you and for them; come not near to Al-Fawahish (shameful sins, illegal sexual intercourse) whether committed openly or secretly; and kill not anyone whom Allah has forbidden, except for a just cause (according to Islamic law). This He has commanded you that you may understand. “
(  سورة الأنعام  , Al-Anaam, Chapter #6, Verse #151)
That  Again in Surah l Nehal Chapter # 16 , Verse # 90, Allah Holds His Decree against Fawahish in the following words:
“Verily, Allah enjoins Al-'Adl (i.e. justice and worshipping none but Allah Alone - Islamic Monotheism) and Al-Ihsan [i.e. to be patient in performing your duties to Allah, totally for Allah's sake and in accordance with the Sunnah (legal ways) of the Prophet صلى الله عليه وسلم in a perfect manner], and giving (help) to kith and kin (i.e. all that Allah has ordered you to give them e.g., wealth, visiting, looking after them, or any other kind of help), and forbids Al-Fahsha' (i.e. all evil deeds, e.g. illegal sexual acts, disobedience of parents, polytheism, to tell lies, to give false witness, to kill a life without right), and Al-Munkar (i.e. all that is prohibited by Islamic law: polytheism of every kind, disbelief and every kind of evil deeds), and Al-Baghy (i.e. all kinds of oppression). He admonishes you, that you may take heed. “    
(  سورة النحل  , An-Nahl, Chapter #16, Verse #90)
That it is further submitted here with respect that "Surely Allah enjoins justice, kindness and the doing of good, to kith and kin; and He forbids all that is shameful, indecent, evil, rebellious and oppressive. Pornography and the culture of pornography have all the three elements which Allah has prohibited in the above verse of the Quran: Fahsha; Munkar, Baghy. All scholars agree pornography is included in the term Fahsha.
That  It is further submitted with respect that the Holy Prophet also strictly condemns all kinds of shameful sins , the relevant Hadith is reproduced hereto below for the perusal of this Honourable Court
(1).    “Narrated Abdullah bin Mas'ud: Allah's Apostle said, "None has more sense of ghaira than Allah, and for this He has forbidden shameful sins whether committed openly or secretly, and none loves to be praised more than Allah does, and this is why He Praises Himself."  (Book #60, Hadith #161)”

(2).    No man or woman should look at the naked body of each other (unless married). Sahih Muslim

(3).    By God, I would prefer to be thrown from the skies and spattered in parts than to look at someone's private parts or let someone look at my private parts. Narrated by Salman. Almabs ooth kitabul istehsan.

(4).    don’t expose your thigh to anyone and don't look at the thigh of any person even if s/he is dead. Narrated Ali ibn abi Talib. Ibn e Maja, Abi Dawud, Darqutani. Tafseer Kabeer.

(5).    “Narrated Abdullah bin Mas'ud: Allah's Apostle said, "None has more sense of ghaira than Allah, and for this He has forbidden shameful sins whether committed openly or secretly, and none loves to be praised more than Allah does, and this is why He Praises Himself."  (Book #60, Hadith #161)”

That it is further submitted with respect that The Constitution of the Islamic Republic of Pakistan, under its principle of policy clause 37 (g), provides that the state shall prevent prostitution, gambling and taking of injurious drugs, printing, publication, circulation  and display of obscene literature and advertisements., the stance of the petitioner is further fortified from the fact that multiple provisions of Pakistan Penal Code are also envisaged to curb shameful sins and acts within Pakistan.  Like Section 292 prohibits the sale of obscene literature and/or books; the punishment is three months imprisonment or a fine or both. Under Section 298 the selling of such obscene literature and/or books to children under 20 year of age is punishable by imprisonment for six months or a fine or both.  Under Section 294 obscene acts and songs are punishable by imprisonment of three months or a fine or both.
6. That the contents of this paragraph No. 4 are false on the face of it ,hence are denied and condemned , the real fact of the matter is that no such committee has been formed to shield children from pornography and exploitation so far, the stance of the petitioner is further cemented from the earlier admissions of the Respondent in the preceding paragraphs of the instant para wise comments where in it has failed to mention that pornographic material forms basis of the specific criteria so evolved by the Government of Pakistan in order to block the websites containing such adult material. The drafter of the instant Para wise comments has failed to appreciate that the subject of the instant writ petition is altogether different with that of the petitions challenging blasphemous or anti state websites . it is further peculiar to be noted here that in case the Government of Pakistan can prohibit and block such blasphemous and anti state websites than y cant it block the pornographic websites. That the stance of the petitioner is further fortified from the fact that the inability and ineffectiveness of the Respondent To prohibit or block the easy access to Pornographic websites in Pakistan ipso facto denotes only one inference and that is “”Pornography is being patronized at a state level in Pakistan. “” that it is further submitted with respect and humility that the contentions raised by the Respondent to the effect that a report of the sub committee will soon be published in the inter ministerial committee is nothing but a pack of lies , as there exist no such committee to adjudicate upon the subject in hand, it is a deliberate attempt on the part of the respondent to defraud and  mislead this Honourable Court.
7.  That the contents of Paragraph No. 5 are misleading on the face  of it hence categorically denied. The real fact of the matter is that the Respondent required least of the time, immense human and financial resources to tackle with the issue of  easy access to pornography , all that is required by them to do is to direct the ISP’s to maintain filters as they have adopted in the case of the Telecommunication sector to prohibit international gateways. That  it is further submitted with respect that even in advanced countries, the ISPs (Internet Service Providers) have made arrangements to block all pornographic material so that children cannot access it. For instance Kingdom of Saudi Arabia only permitted its citizen’s public access to the Internet once the state felt confident it could control the content users could access. Strong Internet filtering was a prerequisite for Internet deployment in the Kingdom, but in Pakistan no such arrangement has so far been devised by the Respondent No.1 or 2 or by the Internet Service Providers working in Pakistan. In addition to it , they are required to direct the ISP’s the Respondents No.___ in the main writ petition to make a catch and kill program with the help of programmer using common tags (adult, xxx, ratedX, Mature, Porn, "sex," "camel sex," "rape video," "child sex video etc) so anytime someone types these common tags in Google or whatever apps they use, this program should b able to block the site from entering your cyber space of Pakistan . it is imperative in the best interest of the justice to be carried out in the instant matter, if the record of the complainst so lodged with this special crisis cell so established by the Respondnet No.2 in addition to the complaints lodged on the toll free No. and the action thereupon taken by the Respondents be directed to be placed in this Honourable Court so as to reach at a fair conclusion in this regard.
8.That the contents of Paragraph No. 6 is vexatious and misleading, the real fact of the matter is that the Respondent Ministry is not at all taking any material steps to ensure a prohibition on the easy access available to Pornography in Pakistan, neither the concerned departments nor officials are seriously acknowledging the catastrophic eventuality of its existence .

PRAYER

Under the circumstances mentioned hereto before it is therefore most humbly prayed that the instant Para Wise comments submitted by the Respondent No.2 in this Honourable Court may very graciously be declared irrelevant , and they be directed to submit proper and relevant para wise comments while keeping in view the contents of the writ petition filed by the petitioner
That it is further most humbly prayed that in the light of the re-reply filed by the petitioner , the titled writ petition may very graciously be accepted in accordance with the prayers made by the petitioner in the main writ petition .
That it is further most humbly requested that while keeping in view of the gravity of the nature involved in the instant matter, a stay order may very kindly be issued against the easy access to pornography in Pakistan in favour of the petitioner and against the respondents .
That any other relief that this honourable court deems just and proper may also very kindly be extended in favour of the petitioner , while keeping in view of the peculiar nature of the instant matter

How to Keep Your Children Safe

If you are a parent, it is very important that you safeguard and watch over your children's internet activity or whenever they access the computer. The children surfs online on their own is very dangerous. Children are curious and love to explore new things. So, if you have children, think about online safety and learn how you can protect them from immoral websites, games and other rough things that will harm your children in the future


How To Protect Your Children Online

Getting more involved and paying more attention to your children and their daily routine is a good way to watch over your children's internet activity. Sit with your children and think of activities that you can both do online. It can be from researching an interesting or an educational topic to playing an online game. You can also gives some drawings to draw, some work to do and keep your children busy in good things instead of leave them freely while they surfing on the Internet.
   

Place your computer in an open area: 

It is always a good idea to keep your computer in an open area, that may be in sitting room and where there is a lot of traffic. This way, you can keep an eye on your children while they surf the net. If they access a site which they are not allowed to go to, it gives you a chance to intervene and teach them why it is important not to visit that specific site.



Make rules:

Making rules and setting boundaries about what sites to visit and what sites not to visit is also a good way to protect your children. Teach your children and talk to them about what he or she is allowed to do on the computer, how long they are allowed to be on the computer, what software programs they can use and what activities or tasks they are allowed to do. Also, talk to your children and make them aware about the dangers of the Internet and talking to strangers online.

Communicate with your children:

Communication is key if you want to protect your children and keep them safe from strangers on the internet. Talk to your children constantly about their Internet activities and get to know which sites they are visiting as well as who they talk to online if they use email and go to chat rooms.


Notice when they playing a Game:

As we inspired by physical existence of anything happened, Computer Games are also a tools of transform respected enjoyment in the player. But Games are distinct from work and sometimes used as an educational purpose. So, it's necessary to watch out your children when they playing games.

Parents Guide!!!

Implement both safety rules and software tools to protect your children online, one without the other is ineffective!!!

Rule: Teach your children to never give personal information over the Internet, such as name, address, telephone number, password, parents' names, the name of any club or team he/she is involved in, name of his/her school, or after school job.
  • In a study of 4 million children between the ages of 7 and 17 who use the Internet, 29% indicated they would give out their home address and 14% would give out their email address if asked .
  • 81% of parents of online teens say that teens aren’t careful enough when giving out information about themselves online and 79% of online teens agree with this 
Rule: Disallow chat rooms / Recognize that chat rooms are the playground of today's sexual predator.
  • Approximately 89% of sexual solicitations of youth were made in either chat rooms or through Instant Messaging .
  • 1 in 5 youth ages 10 to 17 received sexual solicitation or approach in last year.
  • “30% of teenage girls polled by the Girl Scout Research Institute said they had been sexually harassed in a chatroom. Only 7% told their parent because they were worried that their parents would ban them from going online”
  • "86% of the girls polled said they could chat online without their parents’ knowledge, 57% could read their parents’ e-mail, and 54% could conduct a cyber relationship”
  • Law enforcement officials estimate that as many as 50,000 sexual predators are online at any given moment.
Rule: Limit your child's Instant Messaging to a parental approved buddy list. Regularly check your child's buddy list to ensure that it has not been altered.
  • 42% of parents do not review the content of what their teenager(s) read and/or type in chat rooms or via instant messaging .
  • 95% of parents didn’t recognize common chat room lingo that teenagers use to let people they’re chatting with know that their parents are watching. Those phrases are POS (parent over shoulder), P911 (parent alert), BRB (be right back), LOL (laughing out loud) and A/S/L (age/sex/location) .
  • Half of teens ages 13-18 often communicate through the Internet with someone they have not met in person .
  • One-third of youth ages 8-18 have talked about meeting someone they have only met through the Internet .
  • Almost one in eight youth ages 8-18 discovered that someone they were communicating with online was an adult pretending to be much younge.
Rule: Place your computer in an area of your home where you can easily supervise your child's Internet activity. If you allow your child to have a webcam, place it in a public area of your house.
  • 30% of parents allow their teenagers to use the computer in private areas of the house such as a bedroom or a home office. Parents say they are more vigilant about where their teen(s) go online if the computer is in a public area of the household.
Rule: Know your kids’ online activities and friends. (Regularly ask your kids about their online friends and activities. Role play with your child various dangerous scenarios that they could encounter online.)
  • Nearly three out of 10 (28%) of parents don't know or are not sure if their teens talk to strangers online.
  • 65% of all parents and 64% of all teens say that teens do things online that they wouldn’t want their parents to know about.
  • The adult Internet porn industry estimates that some traffic on their sites is 20–30% children .
Tool: Use parental controls/filtering or monitoring technology which block access to dangerous sites and activities.
  • Over half (51%) of parents either do not have or do not know if they have software on their computer(s) that monitors where their teenager(s) go online and with whom they interact.
  • 70% of teens online have accidentally come across pornography on the Web.
  • Nine out of 10 children aged between eight and 16 have viewed pornography on the Internet. In most cases, the sex sites were accessed unintentionally when a child, often in the process of doing homework, used a seemingly innocent sounding word to search for information or pictures .
  • The largest group of viewers of Internet porn is children between ages 12 and 17 .
  • More than 11 million teens regularly view porn online.
Rule: Establish online rules and an agreement with your child about Internet use at home and outside of the home (i.e., at a friend's house, at school, at the library, etc).
  • 77% of parents do not have rules about what their kids can do on the computer, such as restricting the amount of time their kids spend on the computer .
Rule: Spend time online alongside your child and establish an atmosphere of trust regarding computer usage and online activities.
  • Only 25% of children who received a sexual solicitation told a parent.
Rule: Monitor the amount of time your child spends on the Internet, and at what times of day. Excessive time online, especially at night, may indicate a problem. Remind your child that Internet use is a privilege, not a right.
  • Watch for changes in your child's behavior (mention of adults you don't know, secretiveness, inappropriate sexual knowledge, sleeping problems, etc.).
  • 23% of youth reported being “very” or “extremely upset” by exposures to sexual material .
Rule: Do not permit your child to have an online profile containing personally identifiable information or pictures of themselves .
Rule: Check with your child's school to see if student projects, artwork, or photos are being put on school websites. Schools need to be reminded of that risk and encouraged to allow access to student activities posted on the school's website by password only.
Rule: Instruct your kids never to plan a face-to-face meeting with someone that they have met online.



Additional Safety Tips

for Adults

  1. if you agree to meet someone offline that you have met online, take a friend and meet in a public place.
  2. Women should avoid having an online profile.
  3. Make sure the web site has a privacy policy before giving out your email address or personal information or making purchases online.

SUBJECT: WRIT PETITION NO. 1373/2011 TITLED ASIF ALI VS GOVERNMENT OF PAKISTAN, ETC IN THE LAHORE HIGH COURT, LAHORE


Reference Deputy Registrar Judl. Letter No. 21339(g) dated 24 june, 2011, soliciting the comments / report as per the directions of the Honourable Lahore High Court, Lahore in the subject petition.


2. The Contents of the petition have been analyzed and views/ comments of the Ministry of IT as Respondent No.2 are as follows:
a). Government of Pakistan ( GOP) realizes that the appearance and distribution of content affront to the religious and moral values of the Pakistani Citizens, particularly blasphemous and sacrilegious content, at mass level over internet is creating immense discomfort and dismay among the Government and people of Pakistan. A formal mechanism has therefore been established to review request(s) for blocking of undesirable website (s) that propagate propaganda and unscrupulous agendas of inter faith hate, communal disharmony , propagation of discord, blasphemy and anti state content etc. an inter Ministerial Committee ( “The Committee”) was constituted by the Prime Minister of Pakistan in 2006 for formally processing and dealing with the issues / requests for evaluation and blocking of websites ( URLs)  meeting specific criteria . the Committee has representation of various agencies  and departments including , Ministry of IT, Ministry of Religious Affairs , Ministry of Interior , Ministry of Information * Broadcasting , National Telecommunication & Information Technology Security Board (NTISB) security agencies and Pakistan telecommunication Authority (PTA) etc. all such requests are referred to the Ministry of Information & Technology  for placing before the Committee , directives are issued to PTA Accordingly for appropriate blocking through operators. The committee further authorized the Chairman of the Committee to evaluate and decide the …..


Blocking of the cases of urgent nature (i.e blasphemous and ani-state content) and to bring the same in subsequent meeting for codal procedures.


b} The inter-ministerial committee undertakes all efforts to block display of such content in Pakistan as well as engage owners of such websites address the issue of alleged display in Pakistan/withdrawal of such sacrilegious material through alleged mutually agreed arrangement.  The summary of the measures taken so far is as under:


- Currently, an approach of vigilant monitoring of internet in general and Facebook, Youtube in particular is being followed in the spirit of the courts, decisions and Cabinet’s directions to be vigilant and immediately block  only the offending sites without disrupting the flow of information, genuinely needed for the students/researchers.


- The MoIT has convened 20 meetings of the Inter-Ministerial Committee till date.


- A Special crisis cell has been created at PTA, supported by toll free call in numbers and dedicated email addresses for reporting of objectionable websites.


- Cases of urgent nature (Blasphemous and Anti-State are being decided on immediate basis by the Secretary IT and subsequently endorsed by the committee in the subsequent meeting.


- Withdrawal of official material relating to the most condemnable “Burn Quran Day” by the Facebook administration with the engagement of MoIT.


-Until now more than 12500 websites have been blocked from access through the directives of the committee after deliberation.  With regard to the blasphemous caricatures competition on social networking website Facebook, the committee blocked the particular links on Facebook having objectionable material even before the Courts took cognizance of the case.
c} Various write petitions versus federation of Pakistan etc.  came up for hearing before the honourable Sindh and Lahore High Courts regarding the
blocking of blasphemous and pornographic material over interne, hurting the religious/moral feeling of any member of Pakistani Society.  Report on measures taken by GOP was also submitted especially to LHC at various times to apprise the Court about the situation and quantum of job in hand.  The efficient measures taken through this committee for blocking the objectionable contents have been praised and appreciated by the Honourable Lahore High Court while issuing certain guidelines to address the issues related to web-content in alleged large policy context.
3. The Government of Pakistan has undertaken various to handle the situation without deviating from the basic policy of free flow of useful information.  However, during the process of blocking objectionable content, it was observed that the dissemination of such content is extremely fast and such material produced on single website is replicated on thousands of other allied websites within no time.  Also, the technical innovation and development in the filed of computer networking has made it possible to access any content with different applications.  Keeping in view the time and resources required for developing an efficient technical solution that can proactively block the black-listed Websites/URLs, the public support is imperative to overcome the intrinsic limitations of existing and future systems.
4. The treat several collective issues relating to internet e.g “securing intellectual property rights’, “ protecting national security”, preserving religious, cultural and moral values “ and “shielding children from pornography and exploitation”;  the Inter-Ministerial Committee has constituted alleged sub-committee for over arching review of the content regulation mechanism for content filtering, internet café and personal requests.  After detailed analysis in the light of international best practices, the report of the sub-committee will soon be presented to Inter-Ministerial Committee for final recommendations for the perusal/treatment at the relevant fora.
5. As the deployment of alleged technical solution would take time and immense human and financial resources/ the Ministry of Information Technology,  in compliance of the Court directive/guidelines, is creating awareness and requesting the General Public at large to intimate any websites (s)/URL,s which contains such blasphemous, pornographic and objectionable material for necessary action.  It this regard, alleged special crisis cell has already been created in PTa, supported by toll free call-in number (0800-
55055) and dedicated email addresses (complainat@pta.gov.pk) for reporting of websites with objectionable (blasphemous) content.
6. In view of the foregoing and the factual position established at various legal for a that MoIT is taking all possible steps in cognizance of the criticality of the subject matter; the position/report is submitted for kind perusal of the honourable Lahore High Court with the plea for appropriate disposal accordingly.  This report is being issued with the approval of the competent authority please.""

How Pornography Harms Children

While there are many ways that pornography harms children, I want to assure you that every child who views pornography will not necessarily be affected and, at worst, traumatized in the same way. The effects of pornography are progressive and addictive for many people. Just as every person who takes a drink does not automatically become an alcoholic, every child who is exposed to pornography does not automatically become a sexual deviant or sex addict. However, since pornography has a new door to the home, school, and library through the Internet, it is important for us to look at the many ways that pornography can potentially harm our children.

Exposure to Pornography Threatens to Make Children
Victims of Sexual Violence The Internet has proven a useful tool for pedophiles and sexual predators as they distribute child pornography, engage in sexually explicit conversations with children, and seek victims in chat rooms. The more pornography these individuals access, the higher the risk of their acting out what they see, including sexual assault, rape, and child molestation.
  • Pornography's Relationship to Rape and Sexual Violence
    According to one study, early exposure (under fourteen years of age) to pornography is related to greater involvement in deviant sexual practice, particularly rape. Slightly more than one-third of the child molesters and rapists in this study claimed to have at least occasionally been incited to commit an offense by exposure to pornography. Among the child molesters incited, the study reported that 53 percent of them deliberately used the stimuli of pornography as they prepared to offend. i 
    The habitual consumption of pornography can result in a diminished satisfaction with mild forms of pornography and a correspondingly strong desire for more deviant and violent material.ii 
  • Pornography's Relationship to Child Molestation
    In a study of convicted child molesters, 77 percent of those who molested boys and 87 percent of those who molested girls admitted to the habitual use of pornography in the commission of their crimes.iii Besides stimulating the perpetrator, pornography facilitates child molestation in several ways. For example, pedophiles use pornographic photos to demonstrate to their victims what they want them to do. They also use them to arouse a child or to lower a child's inhibitions and communicate to the unsuspecting child that a particular sexual activity is okay: "This person is enjoying it; so will you."
Exposure to Pornography Frequently Results in Sexual Illnesses, Unplanned Pregnancies, and Sexual Addiction
As more and more children are exposed not only to soft-core pornography, but also to explicit deviant sexual material, they are learning an extremely dangerous message from pornographers: Sex without responsibility is acceptable and desirable. Because pornography encourages sexual expression without responsibility, it endangers children's health.
One of the grimmer consequences of adult-like sexual activity among children has been a steady increase in the extent to which youth are afflicted with venereal disease.iv In the United States about one in four sexually experienced teenagers acquires a sexually transmitted disease (STD) every year, resulting in three million cases of teenage STDs. Infectious syphilis rates have more than doubled among teenagers since the mid-1980s. More children contract sexually transmitted diseases each year than all the victims of polio in its eleven-year epidemic, 1942-1953.v
Another obvious result of children involved in adult sexual activity is the increased rate of pregnancy among teenagers.
Research has shown that "males who are exposed to a great deal of erotica before the age of 14 are more sexually active and engage in more varied sexual behaviors as adults than is true for males not so exposed."viOne study reveals that among 932 sex addicts, 90 percent of the men and 77 percent of the women reported that pornography was significant to their addiction.vii

Exposure to Pornography May Incite Children to Act Out 
Sexually against Other Children
Children often imitate what they've seen, read, or heard. Studies suggest that exposure to pornography can prompt kids to act out sexually against younger, smaller, and more vulnerable children. Experts in the field of childhood sexual abuse report that any premature sexual activity in children always suggests two possible stimulants: experience and exposure. This means that the sexually deviant child may have been molested or simply exposed to sexuality through pornography.viii
In a study of six hundred American males and females of junior high school age and above, researcher Dr. Jennings Bryant found that 91 percent of the males and 82 percent of the females admitted having been exposed to X-rated, hard-core pornography. Over 66 percent of the males and 40 percent of the females reported wanting to try out some of the sexual behaviors they had witnessed. And among high schoolers, 31 percent of the males and 18 percent of the females admitted actuallydoing some of the things they had seen in the pornography within a few days after exposure.ix
Exposure to Pornography Shapes Attitudes and Values
Most of us caring, responsible parents want to instill in our children our own personal values about relationships, sex, intimacy, love, and marriage. Unfortunately, the powerful irresponsible messages of pornography may be educating our children on these very important life issues. Just as thirty-second commercials can influence whether or not we choose one popular soft drink over another, exposure to pornography shapes our attitudes and values and, often, our behavior.
Photographs, videos, magazines, virtual games, and Internet pornography that depict rape and the dehumanization of females in sexual scenes constitute powerful but deforming tools of sex education. The danger to children stems at least partly from the disturbing changes in attitude that are facilitated by pornography. Replicated studiesx have demonstrated that exposure to significant amounts of increasingly graphic forms of pornography has a dramatic effect on how adult consumers view women, sexual abuse, sexual relationships, and sex in general. These studies are virtually unanimous in their conclusions: When male subjects were exposed to as little as six weeks' worth of standard hard-core pornography, they:
  • developed an increased sexual callousness toward women
  • began to trivialize rape as a criminal offense or no longer considered it a crime at all
  • developed distorted perceptions about sexuality
  • developed an appetite for more deviant, bizarre, or violent types of pornography (normal sex no longer seemed to do the job)
  • devalued the importance of monogamy and lacked confidence in marriage as either a viable or lasting institution
  • viewed nonmonogamous relationships as normal and natural behaviorxi

Exposure to Pornography Interferes with a Child's
Development and Identity During certain critical periods of childhood, a child's brain is being programmed for sexual orientation. During this period, the mind appears to be developing a "hardwire" for what the person will be aroused by or attracted to. Exposure to healthy sexual norms and attitudes during this critical period can result in the child developing a healthy sexual orientation. In contrast, if there is exposure to pornography during this period, sexual deviance may become imprinted on the child's "hard drive" and become a permanent part of his or her sexual orientation.xii
Psychologist Dr. Victor Cline's findings suggest that memories of experiences that occurred at times of emotional arousal (which could include sexual arousal) are imprinted on the brain by epinephrine, an adrenal gland hormone, and are difficult to erase. (This may partly explain pornography's addicting effect.) Viewing pornography can potentially condition some viewers to have recurring sexual fantasies during which they masturbate. Later they may be tempted to act out the fantasies as sexual advances.
Sexual identity develops gradually through childhood and adolescence. In fact, children generally do not have a natural sexual capacity until between the ages of ten and twelve. As they grow up, children are especially susceptible to influences affecting their development. Information about sex in most homes and schools, comes, presumably, in age-appropriate incremental stages based on what parents, educators, physicians, and social scientists have learned about child development. But pornography short-circuits and/or distorts the normal personality development process and supplies misinformation about a child's sexuality, sense of self, and body that leaves the child confused, changed, and damaged.xiii
Pornography often introduces children prematurely to sexual sensations that they are developmentally unprepared to contend with. This awareness of sexual sensation can be confusing and overstimulating for children.
The sexual excitement and eventual release obtained through pornography are mood altering. For example, if a young boy's early stimulus was pornographic photographs, he can be conditioned to become aroused through photographs. Once this pairing is rewarded a number of times, it is likely to become permanent. xiv The result is that it becomes difficult for the individual to experience sexual satisfaction apart from pornographic images.
Most of us find it difficult to talk to our children about sex in general, let alone the harmful effects of pornography, as graphically described in this chapter. We want to protect the innocence and purity of childhood for as long as possible.

 Agenda of the Meeting:
Agenda of this First Get-Together Meeting, which was organized by Say No to Porn, Lets Wage a War against Pornography in Pakistan (SNTPP) was organized / held presented keeping in view the following three main points:
First: - Introduction of all the Volunteers  who are going to work together (inshAllah) for the welfare of Pakistan in general and to bring a halt to easy access to porn material in Pakistan in particular, so as, to bring their views, opinions, and experiences forward to every other member of the meeting.
Second: - To gather every individual and organization who has been working isolated, bringing them on a single united platform, enforcing unity to get constructive results.
Third: - Formation of a united team, we name it “Lahore Regional Team”. (This name can be changed in future keeping in mind the value-able suggestions and ideas)
Fourth: - To decide the necessary guidelines and program upon which “Lahore Regional Team” may hopefully work in future; in short, the objectives and constitution of “Lahore Regional Team.”

1. The Above named Participants our meeting with an aim to be the change to bring a change in our society. Mr. Fahad Ahmad Siddiqi in his capacity of the Founder and as an Admin of the Group shared with the participant the basic cause, the objectives and the reasons for the creation of the Group in as much as the activities SNTPP intend to initiate by the Volunteers at Lahore. One of these was inviting more volunteers at SNTPP (who have would help us generate awareness amongst the masses). It was found useful and it is decided to be carried on.
2. Mrs. Aneela Shehzad laid emphasis on the need of generating some alternate activity to be provided to the victims of this evil and further suggested for the creation of some online activity like My Mike, She is of the opinion that more n more time should be allowed to the people to speak. One of her idea which was highly appreciated by the participants was to interact with the public on personal level and try to educate them on the subject. She further undertook the responsibility to motivate the inactive members of the SNTPP to Active participation.
3. Mr. Tariq Nawaz also floated Valuable ideas pertaining to the education of the Parents for better protection of the Children using internet facilities. He further shared his views on the point that the basic responsibilities lie on the parents and they should be addressed in the very first instance. Mr. Nawaz has been kind to suggest the participants that Media should also be involved in the activities of the Group. He undertook the responsibility to engage media on the subject accordingly.  Participants agreed that as SNTPP Volunteers / members appreciated the suggestions of Mr. Tariq Nawaz.
4. Mr. Ali Raza, has been kind enough to suggest that modern facilities available on internet should be utilized like Google doc. Mr. Ali Raza also lead the attentive of the participants to the creation of a website to be launched for the purpose of causing awareness with the masses in an effective manner, in this regard he offered his valuable services. To the surprise of the participants he further narrated that efforts could be made that all the activities of the group can be highlighted in an appropriate manner while creating a link on the subject. Ali Raza further ensured the participants that he will create the said link in the next opportunity available to him. In this regard Mrs. Aneela Shehzad very kindly reiterated to provide the data for the link.
 5. Mr. Umair Munir suggested that those SNTPP members at Lahore who couldn’t reach in the meeting for some reasons should be allowed to take part in the next meeting. It is agreed and advised that all SNTPP members should make earnest efforts for increasing the Volunteers by the next meeting
6. Mr. Atif Jameel suggested the Participants of the SNTPP meeting that he can arrange and look after the Students affairs, and undertakes to cause awareness amongst the students segment of the society, Mr. Ahtisham Amjad also enforced the same undertaking.
7. It is further suggested by the participants that the first Sunday of Every Month to hold meetings under the Banner of SNTPP. Mr. Kashif Waseem Voluntarily agreed to undertake the responsibility of gathering the volunteers in this regard.
8. Mr. Rehman Sheraz suggested to the participants that a hand bill / pamphlet should be drafted for causing better and effective awareness to the masses while approaching them in person, he further suggested the participants that he will collect the data provided by the members and filter it out as per the requirements of the SNTPP. At this stage Mr. Tariq Nawaz, Mrs. Aneela Shehzad, Mr. Shahzad Ahmed strongly concentrated on the modes oprendi to be applied while approaching the Public in days herein after to come.
9. Mr. Mohammad Ahmad Virk, Mr. Atif Jameel and Mr. Ahtisham Amjad strongly applauded the suggestions floated by our Volunteers.
10. Mr. Hafeez Rana voluntarily acknowledged providing the participants with the Islamic Teachings on the Subject.


Conclusions of  Meeting:
1- Schedule for the next meeting was decided to be held on Every 1st Sunday of Every Month.
2. A Pamphlet / Handbill will be created which would contain the Message of SNTPP.
3. Genuine attempts will be made to increase the number of Volunteers.
4. Parents will be given education regarding the hazards of the uncontrolled access available to their children, so as they be aware.
5.  Mrs. Aneela Shehzad, Mr. Rehman Sheraz, Mr. Tariq Nawaz & Mr. Ali Raza will co-ordinate for the creation of the Handbill / Pamphlet accordingly.

WRIT PETITION UNDER THE PROVISIONS OF ARTICLE 199 OF THE CONSTITUTION OF ISLAMIC REPUBLIC OF PAKISTAN, 1973

Respectfully Sheweth:

That the brief facts leading to the filling of the instant writ petition are given hereunder:-
  1. That  it is submitted with respect that the petitioner is a citizen of Pakistan  and has filed the instant petition in pro bono publico , is an aggrieved person with sufficient interest in the redresser of his grievances couched in the gist of the instant writ petition . it is further significant to be noted here that if there is any abuse of trust or violation of law, it qualifies any member of the general public as an "aggrieved person" with the right to invoke the constitutional jurisdiction of High Court. There exist flagrant abuse of trust on the part of the Respondents No.1-11 reposed by the Public to act in accordance with law in as much as Public functionaries are supposed to understand the importance and meaning of democratic welfare State.
  2. That it is submitted with respect that Article 1 (I) of the constitution of Pakistan, 1973 provides that ‘Pakistan shall be a Federal Republic to be known as the Islamic Republic of Pakistan, hereinafter referred to as Pakistan’. It may be pertinent to point out that Pakistan has been the first country in modern history to introduce the concept of an ‘Islamic Republic’ which was later on also adopted by Iran and Libya. Not only the name of the country itself but also the political system of its governance incorporated therein shows the wishes of its people to blend modernity with their faith. Article 2 of the constitution, providing that: Islam shall be the state religion of Pakistan’, again highlights the same theme and accomplishes the same object of the creation of Pakistan.
  3. That it is further significant to be noted here that the state religion of Pakistan will be Islam , in as much as it has been undertaken in the Constitution of Islamic republic of Pakistan that Steps shall be taken to enable the Muslims of Pakistan to order their lives in accordance with the fundamental principles and basic concepts of Islam. It if further undertaken that The State shall take necessary steps for prosecution of social justice and eradication of social evils and shall prevent prostitution, gambling and taking of injurious drugs, printing, publication, circulation and display of obscene literature and advertisements. That the stance of the petitioner is further fortified with the commitment undertaken in the Constitution that the state shall try to make the teachings of Holy Quran and Islamiat compulsory to encourage and facilitate the learning of Arabic language.
  4. That it is significant to be noted here that the popularization of Internet by the Government of Pakistan is a welcome step. In a decade Internet is being made accessible throughout Pakistan.  The government has also drastically cut the Internet connection to schools, colleges and universities. The setting up of Internet kiosks and cafes for those who cannot afford to buy a personal computer and an Internet connection at home will no doubt help bridge the digital divide to a great extent. But for the younger generation, this path is full    of dangers. The young generation is now exposed to a flood of information and knowledge, but at the same time they have to browse through junk e-mails luring them to visit pornographic sites. It is very difficult to contain the rain of smut on the Net and protect children from it.  “Fearing pornographic surfing by children and employees, parents and businessmen have urged the government to introduce filtering devices on the Internet that deny access to pornographic sites.” However despite repeated caution notes raised by the media of Pakistan in general and the parents in particular, the Respondents enumerated above have paid no heed so far in this regard.
  5. That it is submitted with humility that pornographic movies and images is another area of grave concern. In Pakistan, this phenomenon may not exist, but some destructive minds may indulge in this practice and spread pornography on the Net. “Pornography is one of the Internets’ worst crimes against our children; a crime justifying sex myths and actual sexual abuse, as well as helping pedophiles to, via the Internet, make appointments with the client. Pornography is, thus, not only an expression of certain individual’s sexual fantasies, but also leads to the growing evil spiral of sexual abuse in practice.”
  6. That it is significant to be noted here that While the world is taking advantage of the vast resources made available at their doorsteps by the Internet, the young and not so young surfers in Pakistan waste their time on obscene sites, it is further submitted with respect that even in advanced countries, the ISPs (Internet Service Providers) have made arrangements to block all pornographic material so that children cannot access it. For instance Kingdom of Saudi Arabia only permitted its citizen’s public access to the Internet once the state felt confident it could control the content users could access. Strong Internet filtering was a prerequisite for Internet deployment in the Kingdom, but in Pakistan no such arrangement has so far been devised by the Respondent No.1 or 2 or by the Internet Service Providers working in Pakistan.
  7. That it is submitted with respect that In Pakistan, with the growing use of Internet, Net cafes and Internet Clubs, the pornography is gaining space. Contrary to the West, the Internet Club users in Pakistan largely comprise children below 18-20 because normally majority of them have no access at homes. Teenagers throng Internet Clubs and then they go to video shops to have porno movies. The watching of such material which is now easily accessible, they tend to act as they see in porno material. It is an undeniable fact that these materials always provoke to have a sexual act. Though there is no data available which can show the gravity of the situation in Pakistan, but circumstantial evidences prove that our children are becoming vulnerable to pornography owing to a variety of reasons. Earlier, only a couple of cinema houses in urban centre were supposed to screen porno shows. Now, the situation is different, the children who have access to Internet can see what they want with a click of mouse. They can download pictures, movies and texts. The most dangerous trend emerging out of children’s access to pornography is the growing cases of incest in middle class in urban areas. Incest cases in our society are not reported in normal circumstances.
  8. That the petitioners seeks the gracious indulgence of this Honourable Court for the redresser of their grievances on the following amongst other inter alia

GROUNDS

  1. That it is pertinent to be noted here that as per the Verse No. 151 of the Surah al Anaam, the Pornography is strictly prohibited. The said verse is reproduced below for the perusal of this Honourable Court

“ Say (O Muhammad صلى الله عليه وسلم): "Come, I will recite what your Lord has prohibited you from: Join not anything in worship with Him; be good and dutiful to your parents; kill not your children because of poverty - We provide sustenance for you and for them; come not near to Al-Fawahish (shameful sins, illegal sexual intercourse) whether committed openly or secretly; and kill not anyone whom Allah has forbidden, except for a just cause (according to Islamic law). This He has commanded you that you may understand. “
(  سورة الأنعام  , Al-Anaam, Chapter #6, Verse #151)
  1. That  Again in Surah l Nehal Chapter # 16 , Verse # 90, Allah Holds His Decree against Fawahish in the following words:

“Verily, Allah enjoins Al-'Adl (i.e. justice and worshipping none but Allah Alone - Islamic Monotheism) and Al-Ihsan [i.e. to be patient in performing your duties to Allah, totally for Allah's sake and in accordance with the Sunnah (legal ways) of the Prophet صلى الله عليه وسلم in a perfect manner], and giving (help) to kith and kin (i.e. all that Allah has ordered you to give them e.g., wealth, visiting, looking after them, or any other kind of help), and forbids Al-Fahsha' (i.e. all evil deeds, e.g. illegal sexual acts, disobedience of parents, polytheism, to tell lies, to give false witness, to kill a life without right), and Al-Munkar (i.e. all that is prohibited by Islamic law: polytheism of every kind, disbelief and every kind of evil deeds), and Al-Baghy (i.e. all kinds of oppression). He admonishes you, that you may take heed. “
(  سورة النحل  , An-Nahl, Chapter #16, Verse #90)
  1. That it is submitted here with respect that "Surely Allah enjoins justice, kindness and the doing of good, to kith and kin; and He forbids all that is shameful, indecent, evil, rebellious and oppressive. Pornography and the culture of pornography have all the three elements which Allah has prohibited in the above verse of the Quran: Fahsha; Munkar, Baghy. Here is a bit of terminology before we review the rest of the evidence prohibiting pornography.
    1.                                                              i.      Fahsha:
According to the Al-Mawrid Arabic-English dictionary of Munir Baalbaki, Fuhash is obscenity, vulgarity, indecency, shamelessness and something that is dirty, filthy and foul.
Fahsha, translated as anything shameful, is a Quranic term which in the Quran and Hadith has been used widely for unIslamic sexual behavior. The Quran uses it as in the above verse (Quran 16:90). It is a set of vices that embraces the whole range of evil and shameful deeds. Scholars of the Quran have included every vice which is intrinsically of a highly reprehensible character into this category whether it is fornication, nudity, public foreplay as depicted in films and photos, pornography, hurling abuses and curse words, promiscuous mixing, or dresses designed to expose the body. At the highest level of Fahsha, Allah has included adultery (Quran 17:32) and same gender sex (Quran 7:80; 27:54).
All scholars agree pornography is included in the term Fahsha.
  1.                                                            ii.      Al-Munkar
Al-Mawrid English - Arabic Dictionary describes Munkar as gross, abominable, detestable, atrocious, outrageous, and flagrant.
As a major Quranic term it means something which is universally acknowledged as bad and immoral. This category includes all evils which have been unanimously condemned by the human conscience and which have been forbidden by Divine Law in all ages.
  1.                                                        iii.      Al-Baghi
According to Al-Mawrid English - Arabic dictionary, this term means wrong, injustice, outrage, and transgression.
  1. That  It is further submitted with respect that the Holy Prophet also strictly condemns all kinds of shameful sins , the relevant Hadith is reproduced hereto below for the perusal of this Honourable Court
(1).    “Narrated Abdullah bin Mas'ud: Allah's Apostle said, "None has more sense of ghaira than Allah, and for this He has forbidden shameful sins whether committed openly or secretly, and none loves to be praised more than Allah does, and this is why He Praises Himself."  (Book #60, Hadith #161)”
(2).    No man or woman should look at the naked body of each other (unless married). Sahih Muslim
(3).    By God, I would prefer to be thrown from the skies and spattered in parts than to look at someone's private parts or let someone look at my private parts. Narrated by Salman. Almabs ooth kitabul istehsan.
(4).    don’t expose your thigh to anyone and don't look at the thigh of any person even if s/he is dead. Narrated Ali ibn abi Talib. Ibn e Maja, Abi Dawud, Darqutani. Tafseer Kabeer.
(5).    “Narrated Abdullah bin Mas'ud: Allah's Apostle said, "None has more sense of ghaira than Allah, and for this He has forbidden shameful sins whether committed openly or secretly, and none loves to be praised more than Allah does, and this is why He Praises Himself."  (Book #60, Hadith #161)”

  1. That it is submitted with respect that The Constitution of the Islamic Republic of Pakistan, under its principle of policy clause 37 (g), provides that the state shall prevent prostitution, gambling and taking of injurious drugs, printing, publication, circulation  and display of obscene literature and advertisements.

  1. That it is further most humbly stated here that multiple provisions of Pakistan Penal Code are also envisaged to curb shameful sins and acts within Pakistan.  Like Section 292 prohibits the sale of obscene literature and/or books; the punishment is three months imprisonment or a fine or both. Under Section 298 the selling of such obscene literature and/or books to children under 20 year of age is punishable by imprisonment for six months or a fine or both.  Under Section 294 obscene acts and songs are punishable by imprisonment of three months or a fine or both.
    1. That it is submitted here with respect that the values that pornography propagates are against the concept of a family. Pornography completely weakens the traditional values that favour marriage, family and children. Is that where we want our society to head. The stance of the petitioner is further fortified from the fact that Pornography clearly exploits women and is complicit in violence against women. Pornography is synonymous with domination, humiliation, and coercion of women, and reinforces sexual and cultural attitudes promoting sexual harassment.  Forget kids for a second. Think about this… In a conservative society like ours a person can throw all caution to the wind and get full access to sexually explicit content with very little hurdles. What then?  Where does this frustration vent out? Pre-marital affairs, extra marital affairs, rape, child molestation and what not!!!
    2. That it is submitted here with respect that it is submitted with utmost respect that our children are our most valuable asset. They are considered to be the future of the nation. They are also the most vulnerable members of our society. Protecting our children against the fear of crime and from becoming victims of crime must be a national priority. Unfortunately the same advances in computer and telecommunication technology that allow our children to reach out to new sources of knowledge and cultural experiences are also leaving them vulnerable to exploitation and harm by computer-sex offenders. It is significant to be noted here that it is the responsibility on the part of the Respondent No.1 to procure all measures which could maintain the public morality in the Country; it is the duty of the state to exercise its writ on this particular subject which is threatening our future i.e. the young generation of Pakistan. In which it apparently failed to its maximum.
    3.  That it is further submitted here with respect that While on-line computer exploration opens a world of possibilities for children, expanding their horizons and exposing them to different cultures and ways of life, they can be exposed to dangers as they hit the road exploring the information highway. There are individuals who attempt to sexually exploit children through the use of on-line services and the Internet. Some of these individuals gradually seduce their targets through the use of attention, affection, kindness, and even gifts. These individuals are often willing to devote considerable amounts of time, money, and energy in this process. They listen to and empathize with the problems of children.  They will be aware of the latest music, hobbies, and interests of children. These individuals attempt to gradually lower children’s inhibitions by slowly introducing sexual context and content into their conversations. There are other individuals, however, who immediately engage in sexually explicit conversations with children. Some offenders primarily collect and trade pornographic images, while others seek face-to-face meetings with children via on-line contacts. The stance of the petitioners is further fortified from the increase in statists of sex related crimes in the Country in the last ten years; it is the high time now to curb this practice. The gravity of the situation can be witnessed by the letter written by one student of Grade 9th namely Abdullah from Karachi aged about 15 years. The copy of the letter is appended herewith as ANNEXURE “A”.
    4.  That it is further submitted here with respect Google ranks Pakistan No. 1 in the world in searches for pornographic terms, outranking every other country in the world in searches per person for certain sex-related content, it is further peculiar to be noted here that Pakistan is top dog in searches per-person for "horse sex" since 2004, "donkey sex" since 2007, "rape pictures" between 2004 and 2009, "rape sex" since 2004, "child sex" between 2004 and 2007 and since 2009, "animal sex" since 2004 and "dog sex" since 2005, according to Google Trends and Google Insights, features of Google that generate data based on popular search terms.
14. That  the stance of the petitioners is further fortified from the fact that The country also is tops -- or has been No. 1 -- in searches for "sex," "camel sex," "rape video," "child sex video" and some other searches that can't be printed here. Google Trends generates data of popular search terms in geographic locations during specific time frames. Google Insights is a more advanced version that allows users to filter a search to geographic locations, time frames and the nature of a search, including web, images, products and news.  Pakistan ranked No. 1 in all the searches listed above on Google Trends, but on only some of them in Google Insights. As per the reports published in FOX News in their 14th July 2010, publication. The copy of the publication is appended herewith as ANNEXURE “B”.
  1. That it is submitted with respect that This country has its own social values and norms that 99.8 percent of the population strictly follows. I remember there was a time, when Anwar Maqsood was asked to not to write a scene where a brother and sister were supposed to be shot in a room with no one else present there. Today, the situation has changed a lot – we need to think upon the customs our Television channels are preaching. We don’t want to hinder the concept of enlightened moderation, however, when such moderation is causing the mental and physical health of our youth, it should be questioned by authority concerned, i.e. PEMRA. However the authority concerned is dumb and numb in this regard for reasons apparently extraneous in this regard.
  2. That  it is further submitted here with respect that Section 27 (a) of the Pakistan Electronic Media Regulatory Authority Ordinance 2002, As Amended by the Pakistan  Media Regulatory Authority Amendment Act 2007 ( Act No. II of 2007)
“27. Prohibition of broadcast media or distribution service operation:-   The Authority shall by order in writing, giving reasons therefore,  prohibit any broadcast media or  distribution service  operator from –
(a) broadcasting or re-broadcasting or distributing any programme or advertisement if it is of the opinion that such particular programme or advertisement is against the ideology of Pakistan or is likely to create hatred among the people or is prejudicial to the maintenance of law and order or is likely to disturb public peace and tranquility or endangers national security or is pornographic, obscene or vulgar or is offensive to the commonly accepted standards of decency;”
  1. That it is submitted here with respect that the petitioners have pinned their hopes in this Honourable Court as there exist no other efficacious, adequate or alternate remedy available for the redresser of their grievances except to invoke the Extra Ordinary Constitutional Jurisdiction of this Honourable Court.

PRAYER
That Under the Circumstances, it is therefore most humbly prayed that the instant writ petition may very graciously be accepted in the interest of the principles of natural justice, fair play and equity.
That it is further most humbly prayed that a direction may very graciously be issued to the Respondent No.1 to place a permanent ban on the circulation and display of obscene literature and advertisements through these websites and they may be permanently blocked or banned in Pakistan for airing, placing, visualizing such pornographic material through internet.
That it is further most humbly prayed that a direction may very graciously be issued to the Respondent No. 2 to appear in this Honourable Court and to state the effective measures that has been initiated by it to curb the obscene display of material and placing a restriction on easy approach to porn sites in Pakistan.
That it is further most humbly prayed that a direction may very graciously be issued to the Respondent No. 2 to draft a regulation which could monitor cyber porn traffic in the country as they have devised to control Telephony Traffic regulation  under the name and title of “Monitoring and Reconciliation of Telephony Traffic Regulations, 2009”, As per the said regulation, all telecom service providers will install system at their own cost to make it possible for authority to monitor telephony traffic.  
That it is further most humbly requested that a direction may further be issued to the Respondent No.3 to ensure placement of permanent ban on pornographic sites by placing a continuous check on the ISP’s working in Pakistan in consultation with the Respondent No.1 & 2 and submit an affirmative report in this Court accordingly.
That it is further most humbly prayed that a direction may very graciously be issued to the Respondent No.2 to ensure effective measures to be adopted by the Internet Service Providers working in Pakistan under its Certificate in respect of placing a ban on such sites to be aired on internet in Pakistan.
That it is further most humbly prayed that a direction may very graciously be issued to the Respondent No. 5 to assist this Honourable Court on this particular issue and to further make recommendation to the Government of Pakistan for the enactment of appropriate laws on the subject of pornography in Pakistan.
That it is further most humbly prayed that a direction may very graciously be issued to the Respondent No.1 & 6 to establish a permanent authority, having legal status, which would monitor such objectionable activities across the world, so that Pornographic websites should be banned forever.
That it is further most humbly prayed that a direction be issued to the Respondent No.8 to get criminal cases registered under the appropriate provisions of Pakistan Penal Code and other relevant provisions of Pakistan Penal Code (PPC) against those who are operating this website in question in Pakistan and punishing them accordingly.
That it is further most humbly requested that a direction may very graciously be issued to the Respondent No.  7 to appear in this Honourable Court and to state those steps they have ensured to protect the order of public morality in Pakistan.
That it is further most humbly prayed that a direction may very graciously be issued to the Respondent No. 8 to appear in person before this Honourable Court and to state those extraneous considerations that apprehend them from initiating strict action against the delinquent TV Channels working in Pakistan under its control from airing obscene and vulgar material for viewership. It is further prayed that a direction may further be issued to the Respondents to ensure strict compliance of the provisions of Section 27 (a) of the PEMRA Act, 2007, as mentioned above.
That it is further most humbly prayed that any other relief that this Honourable Court deems just and proper may very graciously be extended in the favour of the petitioners under the peculiar circumstances of the instant matter.
